TERMS OF SERVICE

1. Acceptance of Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you” or “User”) and FastTest (“fasttest.ai,” “we,” “us,” or “our”) governing your access to and use of the FastTest platform, including the website at fasttest.ai, the FastTest dashboard, the FastTest MCP server, and all related services (collectively, the “Service”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not access or use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

FastTest is an AI-powered testing platform that generates, executes, and maintains end-to-end browser tests. The Service includes AI-powered test generation, automated test execution via Playwright, self-healing selector repair, a cloud dashboard for test management, and an MCP server for integration with AI code editors.

The Service relies on third-party AI/LLM providers and cloud infrastructure. Features, availability, and capabilities may change at any time without notice.

3. Account Registration and API Keys

You must create an account to use certain features of the Service. You are responsible for maintaining the confidentiality of your account credentials and API keys. You are fully responsible for all activities that occur under your account or API keys, whether or not authorized by you.

You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts at our sole discretion, with or without notice, for any reason.

4. Acceptable Use

You agree not to:

  • Use the Service to test websites or applications you do not own or have authorization to test
  • Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
  • Attempt to gain unauthorized access to the Service, other accounts, or any related systems
  • Interfere with or disrupt the integrity or performance of the Service
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service to transmit malware, viruses, or other harmful code
  • Circumvent any rate limits, usage quotas, or billing restrictions
  • Resell, sublicense, or redistribute the Service without our written consent
  • Use the Service to scrape, harvest, or collect data from third-party websites without authorization
  • Use the Service in any manner that could overburden our infrastructure

Violation of these terms may result in immediate termination of your account without refund.

5. Billing, Plans, and Payment

FastTest offers Free and paid subscription plans. By subscribing to a paid plan, you agree to pay the applicable fees. All fees are non-refundable except as required by law. We reserve the right to change pricing at any time with 30 days’ notice.

Free plan users are subject to usage limits (including test run quotas and project limits). Exceeding these limits may result in throttling or suspension of service until the next billing cycle.

We may suspend or terminate your access for non-payment. You are responsible for all applicable taxes.

6. Intellectual Property

Our IP. The Service, including all software, algorithms, designs, documentation, and trademarks, is owned by fasttest.ai and protected by intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Service except the limited right to use it as described herein.

Your Content. You retain ownership of test cases, test data, and other content you create or upload through the Service (“Your Content”). By using the Service, you grant FastTest a worldwide, non-exclusive, royalty-free license to use, process, store, and transmit Your Content solely for the purpose of providing and improving the Service. This includes sending Your Content to third-party LLM providers for AI-powered features.

Aggregate Data. We may use aggregated, anonymized, or de-identified data derived from your use of the Service for any purpose, including improving our products, benchmarking, and analytics. This data will not identify you or your organization.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Without limiting the foregoing, FastTest does not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free
  • Test results will be accurate, complete, or reliable
  • AI-generated test cases will be correct or comprehensive
  • Self-healing features will successfully repair all broken selectors
  • The Service will meet your specific requirements
  • Any defects in the Service will be corrected
  • The Service will be compatible with any specific third-party software, platforms, or configurations

You acknowledge that AI-generated content may contain errors, hallucinations, or inaccuracies. You are solely responsible for reviewing and validating all test results and AI-generated outputs before relying on them in any production or business-critical context.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FASTTEST, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, OR ASSIGNS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, GOODWILL, DATA, BUSINESS OPPORTUNITIES, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE), EVEN IF FASTTEST HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FASTTEST’S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO FASTTEST IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) FIFTY U.S. DOLLARS ($50.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

9. Indemnification

You agree to indemnify, defend, and hold harmless FastTest, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any applicable law or regulation
  • Your Content or any data you submit through the Service
  • Your testing of third-party websites or applications
  • Any claim that your use of the Service infringed or violated any third party’s rights

10. Third-Party Services

The Service integrates with and relies upon third-party services, including but not limited to AI/LLM providers (OpenAI, Anthropic, Azure, Together AI), authentication providers (Clerk), cloud infrastructure (Microsoft Azure, Cloudflare, AWS), and browser automation tools (Playwright). We are not responsible for the availability, accuracy, or conduct of any third-party service.

Your use of third-party services is governed by their respective terms and privacy policies. FastTest disclaims all liability for any loss or damage arising from your reliance on third-party services.

11. Service Availability and Modifications

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

We do not guarantee any uptime or availability. Scheduled and unscheduled maintenance may occur at any time.

12. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to breach of these Terms. Upon termination, your right to use the Service ceases immediately.

You may terminate your account at any time by contacting us. Termination does not entitle you to any refund of prepaid fees.

Sections 6 through 9, 13, 14, and 15 shall survive termination of these Terms.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall be conducted in English, and the seat of arbitration shall be Wilmington, Delaware. The arbitrator’s decision shall be final and binding.

You agree that any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

14. General Provisions

Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and FastTest regarding the Service and supersede all prior agreements.

Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.

Force Majeure. FastTest shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, pandemics, war, terrorism, government actions, power failures, internet or telecommunications failures, or third-party service outages.

No Third-Party Beneficiaries. These Terms do not confer any rights on any third party.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting updated Terms on this page and updating the effective date. Your continued use of the Service after such changes constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
